Won't give me my identification back?

During break-up with my ex, he took my Pport, Birth Certificate, and SS card. We are currently working on a civil agreement in regards to the exchange of property that belongs to one another. His lawyer told my lawyer that he is currently in possession of my ID doents. My question is, can I go in and pick up my ID? The lawyers are hashing out the details of our agreement but in the meantime I would like my doents as soon as possible. I have moved to a new state, my drivers license is expired and I can't even get a new one because they are withholding them. These are of no monetary vale to them, and since they are federally issued to ME isn't it illegal for them to withhold it irregardless of our as yet signed civil agreement?
